How do you protect the good name and

In cyberspace, it is very difficult to track
derogatory use of your brand name or trademark. Some sites can be posted today and gone
tomorrow, having done the damage before you can react.
Did you know registered
trademarks are in effect for just ten years? To continue using a trademark, you
must file an affidavit during year six of its
use. You can continue to renew your
trademark forever, in ten year terms. Just because you didn't know you were
using someone's trademark improperly, you are not off the
hook.
The Lanham Act of 1946 uses specific language about
trademarks.
"Any work, name, symbol or device, or any
combination thereof."
This limitation has been expanded to include a company's image, created through the use of particular
packaging if it seems distinctive or has developed some other meaning as a result of its
recognition.

the courts have some freedom in determining violations and penalties. However, just like
